The President of the Republic of Uzbekistan Shavkat Mirziyoev signed the Law "On the procedure of serving administrative arrest" on 9 January.
The document was adopted by the Legislative chamber on 24 November and approved by the Senate on 13 December 2016.
The main purpose of the law is to establish principles and procedure of serving administrative arrest for persons who had committed administrative offences, envisaged by the legislation. The law defines the legal status of persons subject to administrative arrest, as well as measures aimed at formation of respect for the rights, freedoms and lawful interests of other persons, public and state interests.
The adoption of the Law will contribute to the strengthening of the safeguards guaranteeing the protection of the rights and freedoms of the arrested persons, consistent practice of enforcement in the serving of administrative arrest, raising the efficiency of activity of bodies of internal affairs and the liability of their employees in this area.
The law, in particular, provides for such matters as the admission, detention and accommodation of persons subject to administrative arrest, examination, placement and maintenance, as well as the measures ensuring the regime of detention for administrative detainees, legal status, rights and obligations. The law also sets out regulations relating to personal safety and legal aid to such persons and their participation in civil and family relations, as well as basic requirements to places of detention for administrative detainees, including their material and medical maintenance.
The law comes into force upon expiration of twenty four months from the date of its official publication.
